EIGHT YEARS OF REGULATORY REFORM IN BULGARIA

According to the Organization for Economic Cooperation and Development, regulation, along with monetary and fiscal policy, is one of the three key levers by which governments determine the economic development of their countries and the well-being of their societies. A well-developed regulatory policy, understood as the comprehensive process that governments use to create policies and regulatory measures, is of critical importance for a country in achieving its strategic goals.

Today, 8 years after the start of the regulatory reform in Bulgaria, the process of making the most important decisions in the state, those on regulation through law, is still not sufficiently objective and transparent. These shortcomings have a direct impact on the quality of the regulatory acts produced. And the quality of legislation is directly proportional to the quality of life of Bulgarian citizens. There is an undeniable direct connection between the quality of the legislative process and the well-being of people, the prospects for society and the development opportunities for the state.

What we are observing today is the exact opposite of the expectations that the state and society had at the beginning of the regulatory reform.

  1. There is a pervasive legal nihilism. Non-compliance, non-application and non-fulfillment of the law has become the norm and it starts with the people who make and enforce the rules – the legislators in the National Assembly, who set the standard for the entire society to follow with their own illegal behavior.
  2. Съществува рекорден срив в доверието на гражданите и обществото „в системата“, в държавата и специално в българския законодателния орган, което се дължи на прибързаното, произволното и изобилно законодателстване през последните години.
  3. The quality of Bulgarian regulations, especially laws, continues to be unsatisfactory. This is a consequence of the formal application of the preliminary impact assessment especially by the National Assembly in recent years, etc.
  4. Липсва обратната връзка между законодателния процес и дейността по правоприлагане, което е резултат от непълноценното прилагане на последващата оценка на въздействието на законодателството.
  5. In our country, there is still a lack of a comprehensive approach to public consultations in regulatory decision-making processes, due to the fact that the National Assembly has been refusing to fulfill the requirements of the law for the eighth year and has not conducted public consultations in a structured manner on the bills submitted by the members of parliament.
